About This Policy
This Pre-Order & Early Access Policy applies where Sparkery accepts orders for Hardware that is not immediately available for dispatch.
This Policy should be read alongside the Sparkery Consumer Terms & Conditions and Privacy Policy.

What Is A Pre-Order?
A Pre-Order allows customers to purchase Hardware before stock is available for immediate dispatch.
By placing a Pre-Order, customers reserve stock from a future production or inventory allocation.
A Pre-Order constitutes a purchase of Hardware subject to this Policy and the Sparkery Consumer Terms & Conditions.
Payment
Payment is collected at the time the Pre-Order is placed unless otherwise stated.
The amount payable will be displayed during checkout or communicated through an authorised Sparkery Partner.
Prices, promotions and discounts may vary between sales channels, Partners and promotional campaigns.
Estimated Dispatch Dates
Sparkery may provide estimated launch dates, dispatch dates or delivery windows.
All such dates are estimates only.
Sparkery does not guarantee that Hardware will be dispatched or delivered on any particular date.
Changes To Launch Dates
Product launch dates, manufacturing schedules, inventory availability and delivery timelines may change.
Where material delays occur, Sparkery will make reasonable efforts to notify affected customers.
Priority Allocation
Pre-Orders may be fulfilled in the order received or according to inventory allocations determined by Sparkery.
Sparkery reserves the right to release stock in phases and cannot guarantee a specific production batch or delivery window.
Membership Activation
Unless otherwise stated during checkout or within promotional materials:
Membership Services do not commence at the point of Pre-Order;
Membership Services commence when Hardware is dispatched, activated, paired or otherwise made available for use;
Membership billing will begin in accordance with the Membership Plan selected by the customer.
Where a Membership period is included with Hardware, the included period will commence upon activation of Membership Services.
Customer Cancellation Rights
Customers may cancel a Pre-Order at any time before dispatch.
Where a customer cancels before dispatch, Sparkery will provide a full refund of all amounts paid in relation to the Pre-Order.
Refunds will normally be processed within 14 days of cancellation.
Sparkery Cancellation Rights
Sparkery may cancel a Pre-Order where:
Hardware is no longer available;
Manufacturing or supply chain issues prevent fulfilment;
A pricing, technical or administrative error has occurred;
Fraudulent activity is suspected.
Where Sparkery cancels a Pre-Order, a full refund will be provided.
Promotional Offers
Sparkery may offer promotional benefits in connection with Pre-Orders including:
Included Membership periods;
Lifetime Memberships;
Priority access;
Launch gifts;
Founder benefits;
Partner-funded incentives;
Discounted pricing.
Eligibility requirements and offer conditions will be communicated at the point of purchase.
Promotional benefits are personal to the customer and may not be transferred unless expressly stated otherwise.
Limitation Of Liability
Nothing in this Policy excludes any rights available under applicable consumer protection legislation.
Sparkery’s liability shall not exceed any amount paid by the customer for the relevant Pre-Order except where such limitation would be unlawful.
